eero Dynamic DNS Service - Global Acceptable Use Policy

Acceptance of eero Dynamic DNS Acceptable Use Policy.
Welcome to the eero Dynamic DNS service (the “DDNS Program”). Your use of the DDNS Program (the “DDNS Subscription”) is subject to this acceptable use policy (“AUP”), which supplements the Terms of Service Agreement (“TOS Agreement”) located at https://eero.com/legal/tos, or successor website, and the eero Secure/Secure+ Service Additional Terms (“Additional Terms”) located at https://eero.com/legal/eero-secure, or successor website, each incorporated by reference. The terms “you” and “your” refers to the Registered User and any User who uses DDNS in connection with such Registered User's Account. Capitalized terms not defined in this AUP will have the meaning set forth in the TOS Agreement or Additional Terms, as applicable. eero LLC (“eero”, “we”, and “our”) reserves the right to update and change this AUP and any documents incorporated herein by reference from time to time in accordance with the TOS Agreement or the Additional Terms, as applicable. If any change is found invalid or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. You can always find the most recent version of this AUP at www.eero.com/legal/DDNS, or successor website, and the most recent version of the TOS Agreement or the Additional Terms at the URL(s) indicated above. In the event of any inconsistency between this AUP, the Additional Terms and the TOS Agreement, this AUP will control with respect to DDNS.
IF YOU DO NOT ACCEPT THIS AUP, YOU MAY NOT USE OR ACCESS THE DDNS PROGRAM.
Additional Policies and Terms.
The Amazon Web Services (“AWS”) Acceptable Use Policy (“AWS AUP”), located at https://aws.amazon.com/aup/, or successor website, is incorporated by reference and governs your use of the DDNS Subscription in addition to this AUP, except as otherwise noted in this AUP. AWS is an affiliate entity who may update and change the AWS AUP from time to time. If any such change is found invalid or for any reason unenforceable, that change will be severable and will not affect the validity or enforceability of any remaining provisions. In the event of any inconsistency between this AUP, the Additional Terms, the TOS Agreement, or the AWS AUP, this AUP will control with respect to the DDNS Program and DDNS Subscription.

DDNS Subscription Acceptable Use.
You will not (and will not allow any third party to) use the DDNS Subscription in a manner that violates this AUP. The DDNS Subscription is offered to you for personal use only. You may not use the DDNS Subscription for commercial use. In addition to your representations, warranties, obligations, and any prohibitions on use in the TOS Agreement or the Additional Terms, (i) you represent and warrant to the best of your knowledge that your use, either directly or indirectly, of the DDNS Subscription, does not infringe the legal rights of any third party; (ii) you may not use, or encourage, promote, facilitate or instruct others to use the DDNS Subscription for any illegal, harmful, fraudulent, infringing or offensive use, or to transmit, store, display, distribute or otherwise make available content that is illegal, harmful, fraudulent, infringing or offensive; and (iii) you may not use the DDNS Subscription for e-mail, messages, promotions, advertising, or solicitations of any kind. If you violate this AUP or authorize others to do so, and/or help others to do so, eero and/or our affiliates may immediately suspend or terminate your use of the DDNS Subscription, any other Services associated with your Account(s), and/or your Account(s), at any time without notice. eero and/or our affiliates retain sole discretion to immediately suspend or terminate the foregoing and such termination can remain permanent and/or prevent you from creating an Account or utilizing Services in the future.
You agree that you will be responsible for your use of the DDNS Subscription, and you agree, to the fullest extent possible by law, to defend, indemnify, and hold harmless eero, its licensors, and their officers, directors, employees, consultants, affiliates, subsidiaries and agents (collectively, the “eero Entities”) from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with (i) your violation of this AUP or any representation, warranty, or agreements referenced herein, or any applicable law or regulation; or (ii) your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property or privacy right. eero reserves the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (and without limiting your indemnification obligations with respect to such matter), and in such case, you agree to cooperate with eero’s defense of such claim. This provision does not require you to indemnify the eero Entities for any unconscionable commercial practice, fraud, deception, false promise, misrepresentation, or concealment, suppression or omission of any material fact in connection with the DDNS Subscription. You agree that the provisions in this section will survive any termination of your Account, this AUP, or your access to the DDNS Subscription and they will be enforced to the fullest extent possible by law.
Monitoring and Enforcement.
eero and/or our affiliates reserve the right, but do not assume the obligation, to investigate any violation of this AUP or misuse of the DDNS Subscription. eero, and/or our affiliates, may:
investigate violations of this AUP or misuse of the DDNS Subscription; or
remove, disable access to, or modify any content or resource that violates this AUP or any other agreement we may have with you for the DDNS Subscription or its related services.
eero, and/or our affiliates reserve the right to forward any complaint to the applicable DDNS Subscription customer as part of an investigation.
eero and/or our affiliates may report any activity that we suspect violates any law or regulation to appropriate law enforcement officials, regulators, or other appropriate third parties. Our reporting may include disclosing eero DDNS Subscription customer information, and/or abuse reporting information, as appropriate or required. We also may cooperate with law enforcement agencies, regulators, or other appropriate third parties to help with the investigation and prosecution of illegal conduct by providing network and systems information related to alleged violations of this AUP.
Reporting of Violations of this Policy.
If you become aware of any violation of this AUP, you will immediately notify us and provide eero and/or our affiliates with assistance, as requested, to stop or remedy the violation. To report any violation of this AUP, please follow the AWS abuse reporting process. You must use the AWS abuse reporting process to submit a valid abuse report. eero will only take action on abuse reports submitted through the AWS abuse reporting process; abuse report submissions through any other means will be automatically rejected and no action will be taken.
Suspension of Services; Termination; Breach of Agreement.
You agree that your failure to comply completely with the AUP, AWS AUP, and any eero rule or policy may be considered a material breach of this AUP and could result in the immediate suspension and/or termination of your DDNS Subscription. eero's failure to act upon or notify you of any event that may constitute a breach will not relieve you from or excuse you of the fact that you have committed a breach.
eero and/or our affiliates reserve the right to suspend or terminate the DDNS Program at any time, without notice, and with or without cause and at eero’s sole discretion. If eero suspends or terminates your use of the DDNS Program outside of a violation of this AUP, such suspension or cancellation may be governed by the Additional Terms, TOS Agreement, or AWS AUP.
